Consumer staples sector lags
Dow +120.51 at 46138.62, Nasdaq +227.82 at 22489.15, S&P +38.48 at 6638.82

[BRIEFING.COM] The S&P 500 (+0.6%), Nasdaq Composite (+1.1%), and DJIA (+0.3%) are trading in a stable range as the session approaches midday. 

Sector strength remains somewhat variable but relatively strong, with seven S&P 500 sectors holding gains.

Furthermore, losses among today's laggards have narrowed, as only the consumer staples sector (-0.6%) still holds a loss wider than 0.5%. 

Within the sector, a slight majority of names hold modest losses, with tobacco companies Philip Morris International (PM 162.47, -3.83, -2.30%) and Altria (MO 64.52, -0.99, -1.51%) retreating the furthest.

On the trade front, the Supreme Court will hear a case on the legality of President Trump's tariffs implemented under the International Emergency Economic Powers on November 5.
